A judge has rejected Rainier resident WhiteWind Weaver?s motion for summary judgment Friday in a lawsuit filed by JZK, Inc., Yelm channeler JZ Knight?s company.
JZK, Inc. is claiming that Weaver breached a contract she signed before attending a seminar led by Knight.
In August 2006, JZK, Inc. filed a lawsuit against Weaver and the company, ?The Art of Life Coaching? after Weaver held a four-day event in Rainier called, ?Health, Wealth and Wisdom: An Equation for a Great Life.?
JZK, Inc. is alleging that Weaver wrongfully used some of the information she learned at Ramtha?s School of Enlightenment during Weaver?s own Art of Life Coaching event, which was held just 20 days before the JZK lawsuit was filed.
The case is currently slated to go to trial Monday, Sept. 8 in Thurston County Superior Court.
?I feel good about any jury we would have in our case,? Weaver said. ?It?s not that we lost anything.?
?It cleared the board for clarity.?
JZK, Inc. spokesman Mike Wright said his side is also pleased with the judge?s verdict Friday.
?We?re happy to have cleared this obstacle and proved there is a legal basis (for this suit),? Wright said. ?I think it?s a basis of resolving best addressed by 12 people of the community.?
On a confidentiality form, students of Knight?s must agree not to teach or disseminate any information they obtain at RSE.
If they violate those terms, the form states that RSE would seek damages in the amount of what the person earned as a result of disseminating that information.
The judge in the lawsuit determined during a hearing last week that the contract used by RSE is not unconscionable, and defense attorneys can?t keep bringing that issue up, Wright said.
?Up until now there has been a lot of discovery (in this case),? Weaver said. ?I look forward to explaining all the issues they?ve brought forward.?
?Having this case will be an asset for the greater community and provide clarity.?
Weaver recently closed her Yelm restaurant, Two Friends Bistro, and said defending the expensive lawsuit was a factor in that decision.
